This website is operated by Scent In The City (“SITC,” “we,” “us,” “our”). By accessing our site or purchasing from us, you agree to these Terms, our Shipping Policy, Return & Refund Policy, and Privacy Policy (collectively, the “Agreement”).

 

1) Online Store Terms

You confirm you are at least the age of majority in your jurisdiction (or have parental consent). You will not use the site for unlawful purposes or to violate any laws. We may terminate or refuse service at any time for any reason.

 

2) Order Acceptance, Fraud Screening & Right to Cancel

All orders are offers to purchase; acceptance occurs when we dispatch the order and send shipment confirmation. We may refuse, limit, or cancel any order (e.g., suspected fraud, reseller activity, pricing/stock errors, regulatory restrictions). For international orders, we may cancel at our discretion if we believe transit or regulatory complications are likely; in that case we will issue a full refund prior to shipment.

 

3) Product & Hazardous Materials Notice

Many products are alcohol-based fragrances that qualify as restricted hazardous materials (HAZMAT). Availability, packaging, carrier options, and routes may vary due to HAZMAT handling requirements. Color/appearance may differ by device; such variations are not defects.

 

4) Pricing, Promotions & Errors

Prices, promotions, and availability may change without notice. We may correct any error or inaccuracy (including after submission) and cancel orders affected by such errors. Discount codes are single-use unless stated otherwise, non-transferable, and may not be combined.

 

5) Shipping; Risk of Loss; Delivery Estimates

Shipping is governed by our Shipping Policy. Title and risk of loss pass to you upon transfer to the carrier. Any delivery dates provided by us or the carrier are estimates only and not guaranteed. We are not liable for delays caused by carriers, customs, or events beyond our control.

 

6) International Orders, Customs & Duties

International shipments (including to Canada) may undergo extended customs inspection—especially fragrances. You are responsible for all import duties, taxes, and fees. Once shipped, orders cannot be canceled or refunded while in transit or under customs review; refunds are only issued if the parcel is returned to us or declared lost after carrier investigation, per the Shipping Policy. International shipping fees are non-refundable once a shipment has been processed, labeled, or dispatched.

 

7) Returns, Exchanges & Refunds

Returns/exchanges and refund eligibility are governed by our Return & Refund Policy. For hygiene and safety, opened or used fragrances are not returnable. Unauthorized returns may be refused. Original and return shipping costs are non-refundable.

 

8) Account, Billing & Information Accuracy

Provide current, complete, and accurate information. You authorize us and our processors to charge your payment method for your order, taxes, and shipping. We may cancel or limit orders per person/household/account or by payment/address.

 

9) Intellectual Property & User Content

All site content is owned by SITC or its licensors and protected by IP laws. You may not copy, modify, distribute, or exploit our content without written consent. If you submit reviews, ideas, or comments, you grant us a non-exclusive, worldwide, royalty-free license to use them in any media. Do not submit unlawful, defamatory, or infringing material.

 

10) Third-Party Tools & Links

We may offer access to third-party tools and link to third-party sites (e.g., Shopify, Google, Meta, PayPal). They are provided as-is without warranties. We are not responsible for third-party content, policies, security, or breaches. Your data use is governed by our Privacy Policy and the third parties’ policies.

 

11) Prohibited Uses

You may not use the site to: (a) break laws; (b) infringe IP; (c) harass or discriminate; (d) transmit malware; (e) scrape or mine data; (f) misrepresent identity; (g) bypass security. We may terminate access for violations.

 

12) Warranties & Disclaimers

The site, products, and services are provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement.

 

13) Limitation of Liability

To the maximum extent permitted by law, SITC and its officers, employees, agents, and suppliers shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits/revenue; or data loss arising from use of the site/products, shipping delays, customs actions, or third-party services. Our total liability shall not exceed the amount you paid for the applicable order.

 

14) Indemnification

You agree to indemnify and hold SITC and its affiliates harmless from claims, damages, liabilities, and expenses (including attorneys’ fees) arising from your breach of this Agreement, your misuse of the site, or your violation of laws or third-party rights.

 

15) Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control (e.g., carrier interruptions, customs holds, accidents, labor disputes, shortages, acts of God, pandemics, government actions).

 

16) Severability & No Waiver

If any provision is unenforceable, the remainder remains in effect. Our failure to enforce any right is not a waiver.

 

17) Governing Law; Venue

This Agreement is governed by the laws of the State of Florida, without regard to conflicts principles. Exclusive venue for any dispute shall be the state or federal courts located in Broward County, Florida, and you consent to their jurisdiction.

 

18) Changes to Terms

We may update these Terms at any time by posting a revised version with a new “Last updated” date. Continued use constitutes acceptance.
